Canada has removed its interim policy enabling foreign visitors to apply for work permits within the country.

August 28, 2024, Ottawa With immediate effect, Immigration, Refugees and Citizenship Canada (IRCC) has terminated a provisional government policy that permitted travelers to petition for a work permit from within the country.

The COVID-19 pandemic-related travel restrictions prevented some tourists from leaving the country, thus the IRCC developed the policy in August 2020 to assist those visitors. Visitors to Canada may apply for a work visa under the scheme without needing to exit the nation. Additionally, while they awaited the outcome of their new work permit application, foreign nationals who had possessed a work permit for the preceding 12 months but had altered their status to “visitor” could seek to work lawfully in Canada.

The IRCC is terminating the temporary policy, despite the fact that it was scheduled to expire on February 28, 2025. This action is being taken as a part of our broader efforts to maintain the integrity of the immigration system and adjust the number of temporary residents in Canada. The IRCC is also aware that certain unscrupulous individuals were deceiving foreign people into working in Canada without authorization by utilizing the rules.

Applications filed before August 28, 2024 will still be processed by IRCC in accordance with the policy.

IRCC Designates New Body for Credential Assessments for architects interested in immigrating to Canada.

IRCC Approves New Organization for Architect Credential Assessments in Canada

A new professional organization has been approved by Immigration, Refugees and Citizenship Canada (IRCC) to provide educational credential assessments (ECAs) to architects who wish to immigrate to Canada.

Eligibility Requirements for Economic Permanent Residence

Applications for programs leading to economic permanent residence must show that their foreign degrees, diplomas, or certificates are genuine and equal to credentials from Canada in order to meet eligibility requirements. To accomplish this, applicants must get an ECA from a professional body or multi-purpose ECA organization that has been designated by the IRCC.

Authorization of the Canadian Architectural Certification Board

The Minister has assigned the Canadian Architectural Certification Board (CACB) the authority to grant ECAs as of May 20, 2024, to applicants who have indicated that their major or intended vocation is the National Occupational Classification (NOC) of “Architect” (NOC 21200). The CACB’s ECAs will establish how international degrees relate to Canadian qualifications required for architectural practice. Moreover, ECAs are acknowledged as a stage in the architect licensure procedure.

Essential Work Status Granted to Spouses of Full-Time Students in Canada

Spouses of Full-Time Students in Canada Now Eligible for Essential Work Status

Subparagraph 205(c)(ii) of the Immigration and Refugee Protection Regulations (IRPR) required the following spouses or common-law partners of full-time students to do work, and the Minister identified that work as necessary on April 30, 2024:

  • Wives or common-law partners of graduate program participants enrolled full-time (master’s and doctoral),
  • Spouses or common-law partners of full-time students participating in a province or territory’s pilot program eligibility. 
  • University full-time students enrolled in professional degree programs (such as law, dentistry, or medicine)
  • Spouses or common-law partners who are extending their work permit as spouses of full-time students enrolled in a post-graduation work permit (PGWP) qualifying program of study at a PGWP-eligible designated learning institution and who currently possess a valid open work permit under the C42 category.
